Welcome to Overland Tailor Tuning (“OTT,” “Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of https://overlandtailor.com (the “Website”) and all related automotive tuning services, calibrations, software, hardware, remote flashing solutions, retailer-installed services, and technical support (collectively, the “Services”).

By accessing or using the Website or Services, you agree to be bound by these Terms. If you do not agree, do not use the Website or Services.

1. Nature of OTT Services

OTT provides aftermarket automotive ECU tuning and calibration services, including but not limited to:

  • Vehicle-specific ECU calibrations

  • Remote tuning and flashing solutions (including VF Tuner, HP Tuners, and COBB AccessPort)

  • Performance and drivability optimization

  • Retailer-installed and self-install tuning packages

  • Related hardware, software, and technical support

Unless explicitly stated otherwise in writing, OTT services are intended for aftermarket performance use and may affect vehicle emissions, drivability, fuel economy, and component longevity.

2. Vehicle Condition & Customer Responsibility

By purchasing or using OTT Services, you acknowledge and agree that:

  • Your vehicle is in proper mechanical condition prior to tuning

  • OTT is not responsible for pre-existing issues, including but not limited to engine, transmission, driveline, electrical, fuel system, or sensor faults

  • You are responsible for providing accurate vehicle information, including ECU ID, model year, engine, transmission, and modification details, including any removal of factory-installed emissions components.

  • Dealer software updates, prior tuning, or aftermarket modifications may impact compatibility or results

  • Modifications of factory-installed components may impact your automobile insurance. Consult with your insurance provider.

OTT reserves the right to refuse service if the vehicle condition or configuration is unsuitable.

3. Emissions Compliance & Legal Use

You are solely responsible for ensuring compliance with all applicable laws and regulations, including:

  • Federal, state, provincial, and local emissions laws

  • EPA and CARB requirements

  • Road-use legality in your jurisdiction

OTT does not guarantee emissions compliance unless explicitly stated in writing (e.g., calibrations covered under an active CARB Executive Order or SEMA Certified Emissions). Use of non-EO or CE calibrations on public roadways may be illegal in certain jurisdictions. OTT cannot be responsible for states that follow CARB but fail to recognize OTT's CARB Executive Orders. 

4. Performance Disclaimer

Automotive tuning involves inherent risk. You acknowledge that:

  • Performance gains and drivability improvements are not guaranteed

  • Results vary based on vehicle condition, fuel quality, altitude, climate, load, and driving style

  • Increased performance may place additional stress on vehicle components

OTT is not responsible for mechanical failure, drivetrain damage, or reduced component lifespan resulting from use of its Services.

5. Manufacturer Warranty

OTT does not guarantee preservation of any manufacturer or extended warranty. Vehicle manufacturers and dealers may deny warranty coverage due to aftermarket tuning, even if a vehicle is returned to stock.

6. Remote Tuning & Flashing Responsibility

For remote or self-install tuning:

  • You are responsible for following all provided instructions

  • You must use compatible hardware, cables, software, and operating systems

  • Interruptions during flashing, incorrect procedures, or user error may result in ECU damage or vehicle inoperability

OTT is not liable for damage caused by improper installation, interrupted flashes, battery voltage issues, or misuse of tuning devices.

7. Retailer & Third-Party Services

OTT works with independent retailers and installers. These parties are not employees or agents of OTT.

OTT is not responsible for:

  • Labor performed by retailers

  • Diagnostic conclusions made by third parties

  • Installation errors or shop-specific practices

Any labor disputes or workmanship issues must be resolved directly with the retailer.

8. Refunds, Cancellations & Chargebacks

Due to the custom and digital nature of tuning services:

  • All sales are final once a tuning file, license, or service has been issued

  • No refunds for delivered, partially delivered, or installed services

  • Hardware returns, if applicable, are subject to separate return policies

Unauthorized chargebacks may result in service termination and revocation of access.

9. Intellectual Property

All OTT calibrations, tuning files, software, documentation, and related materials are the exclusive intellectual property of Overland Tailor Tuning, LLC.

You may not:

  • Copy, share, resell, or distribute OTT tuning files

  • Transfer calibrations between vehicles

  • Reverse engineer or modify OTT intellectual property

  • Allow unauthorized third-party use

  • Obtain to provide to a competitor

Violation may result in legal action and permanent service termination.

10. Limitation of Liability

To the fullest extent permitted by law, OTT shall not be liable for:

  • Vehicle damage or failure

  • Loss of use

  • Loss of profits

  • Personal injury

  • Indirect, incidental, or consequential damages

Your sole remedy is the discontinuation of use of the Services.

11. Indemnification

You agree to indemnify and hold harmless OTT, its owners, employees, contractors, retailers, and affiliates from any claims arising from:

  • Use or misuse of OTT Services

  • Vehicle operation after tuning

  • Regulatory or emissions violations

  • Third-party claims related to modified vehicles

The customer alone bears the cost to repair and/or replace components of the Vehicle or the Vehicle itself for any damage due to the Work.

Customer waives and releases Overland from any and all claims, actions, causes of action that Customer has now or may have in the future arising out of or in any way connected or related to, directly or indirectly, the Work.

12. Termination of Service

OTT reserves the right to refuse service, suspend access, or terminate Services at its discretion, including for misuse, misrepresentation, abuse, or violation of these Terms.

13. Governing Law

These Terms shall be governed by the laws of the state of Alabama, Jefferson County, without regard to conflict of law principles.

14. Changes to These Terms

OTT may update these Terms at any time. Continued use of the Website or Services constitutes acceptance of any revised Terms.

Remote Tuning Liability Waiver

This Remote Tuning Liability Waiver (“Waiver”) is entered into by the customer (“Customer,” “you,” or “your”) and Overland Tailor Tuning (“OTT,” “Company,” “we,” “us,” or “our”).

By purchasing, installing, or using any remote tuning, self-install, or customer-performed flashing services provided by OTT, you acknowledge that you have read, understood, and agreed to this Waiver.

1. Acknowledgment of Remote Tuning Risks

You understand and acknowledge that remote ECU tuning and flashing involves inherent risks, including but not limited to:

  • ECU corruption or failure

  • Vehicle inoperability (“bricking”)

  • Loss of communication during flashing

  • Software incompatibility

  • Electrical or battery-related interruption

  • Incorrect ECU identification or configuration

These risks exist even when instructions are followed correctly.

2. Customer Responsibilities

You agree that you are solely responsible for:

  • Providing accurate vehicle information, including ECU ID, model year, engine, transmission, and modifications

  • Ensuring the vehicle battery is properly charged and stabilized during flashing

  • Using compatible hardware, cables, devices, and software

  • Following all OTT instructions exactly and in full

  • Ensuring a stable power source and uninterrupted flashing process

Failure to meet these requirements increases the risk of ECU damage.

3. No Guarantee of Recovery

You acknowledge that:

  • Not all ECU failures or flash interruptions are recoverable

  • ECU recovery, replacement, or reprogramming may require dealer service or ECU replacement

  • OTT does not guarantee ECU recovery in the event of failure

  • Any costs related to towing, diagnostics, ECU replacement, or dealer services are the Customer’s responsibility

4. Vehicle Condition & Pre-Existing Issues

You represent that your vehicle is in good mechanical and electrical condition prior to tuning.

OTT is not responsible for:

  • Pre-existing mechanical or electrical issues

  • Problems caused by prior tuning, dealer updates, or aftermarket modifications

  • Failures unrelated to OTT’s calibration files

5. Limitation of Liability

To the fullest extent permitted by law, you agree that OTT shall not be liable for:

  • ECU damage or failure

  • Vehicle downtime or loss of use

  • Towing or transportation costs

  • Repair or replacement costs

  • Dealer or third-party service charges

  • Consequential, incidental, or indirect damages

Your sole remedy is the discontinuation of use of OTT services.

6. Assumption of Risk

You voluntarily assume all risks associated with:

  • Remote tuning

  • Self-installation

  • Customer-performed flashing

  • Post-tuning vehicle operation

You understand that OTT does not have physical control over your vehicle during remote services.

7. No Warranty or Guarantee

OTT provides remote tuning services “as is” and makes no warranties, express or implied, including:

  • Fitness for a particular purpose

  • Error-free operation

  • Compatibility with future OEM updates

  • Protection of manufacturer warranties

8. Indemnification

You agree to indemnify and hold harmless OTT, its owners, employees, contractors, and retailers from any claims, losses, damages, or expenses arising from:

  • Remote tuning or flashing

  • Vehicle operation after tuning

  • Improper installation or misuse

  • Regulatory or emissions violations

9. Acknowledgment & Acceptance

By proceeding with remote tuning services, you acknowledge that:

  • You have read and understand this Waiver

  • You accept all risks associated with remote tuning

  • You waive any claims against OTT arising from remote flashing or self-install services

10. Governing Law

This Waiver shall be governed by and construed in accordance with the laws of Alabama, Jefferson County , without regard to conflict of law principles.

Emissions & CARB Compliance Disclosure

Overland Tailor Tuning (“OTT”) is committed to transparency regarding emissions compliance and regulatory requirements related to aftermarket automotive tuning.

This disclosure is intended to clearly explain how emissions laws may apply to OTT products and services.

1. General Emissions Notice

Aftermarket ECU tuning and vehicle modifications may affect emissions-related systems and vehicle compliance with federal, state, provincial, or local laws.

It is the sole responsibility of the vehicle owner to ensure that any modifications, calibrations, or tuning services comply with applicable emissions regulations in their jurisdiction.

2. CARB Executive Order (EO) Calibrations

Some OTT calibrations may be covered under an active California Air Resources Board (CARB) Executive Order (EO).

When applicable:

  • EO-approved calibrations are legal for use on public roadways only for the specific vehicle configurations listed in the EO

  • The EO number must match the vehicle’s:

    • Model year

    • Engine

    • ECU family

    • Emissions system configuration

EO coverage does not automatically apply to all vehicles or all OTT calibrations.

OTT will clearly identify when a calibration is EO-approved.

3. Non-EO / Off-Road Use Calibrations

Any OTT calibration not explicitly covered by a CARB Executive Order is:

  • Intended for off-road, racing, or closed-course use only

  • Not legal for use on public roadways in California and certain other jurisdictions

Installation or use of non-EO calibrations on emissions-controlled vehicles operated on public roads may violate emissions laws.

4. Dealer & Inspection Considerations

Vehicle manufacturers, dealerships, and inspection agencies may:

  • Detect aftermarket tuning

  • Deny warranty coverage

  • Fail emissions inspections

  • Refuse to perform software updates

Returning a vehicle to a stock calibration does not guarantee emissions compliance, inspection approval, or warranty reinstatement.

5. Remote Tuning & Customer Responsibility

For remote or self-install tuning services:

  • OTT relies on customer-provided vehicle information

  • ECU identification and compatibility must be confirmed prior to tuning

  • Incorrect information may result in unsupported or non-compliant calibrations

OTT is not responsible for emissions violations resulting from inaccurate vehicle data or misuse.

6. No Legal or Regulatory Advice

OTT does not provide legal or regulatory advice regarding emissions compliance.

Customers are encouraged to consult:

  • State or local emissions authorities

  • Regulatory agencies (EPA, CARB)

  • Qualified emissions or legal professionals

7. Customer Acknowledgment

By purchasing or using OTT products or services, you acknowledge that:

  • You understand emissions laws vary by jurisdiction

  • You are responsible for determining legality of use

  • OTT is not liable for emissions violations, fines, penalties, or inspection failures

8. Questions About EO Status

If you have questions about whether a specific OTT calibration is CARB EO-approved for your vehicle, please contact us before purchase with:

  • Vehicle year, make, model

  • Engine and transmission

  • ECU ID

  • Current modifications
